The Site allows Mad Perfumery to offer Mad perfumes and cosmetics (hereinafter the “Products”) for sale to Internet Users on the Site (hereinafter referred to as “Users”).

It is stated that the Products are solely intended for the User’s personal use and not any kind of professional use.

The User who wishes to purchase on the Site states he has full legal capacity.

The purpose of these General Terms and Conditions for Sale is to define the Parties’ rights and obligations arising from the online sale of Products offered on the Site from UAE, exclusively because of the relationships they establish on the Internet and only on the Site. They determine all the steps necessary to place an order as described in Article 5: « Order », and ensure follow-up of this order between the parties.

The Products offered for sale by MAD House are those listed on the Site on the day of consultation of the Site by the User, within the limits of available stocks and subject to the conditions stipulated in the preamble hereinabove. Goutal reserves the right to withdraw Products from sale at any time.

MAD takes great care to present the Products on the Site in accordance with the requirements of Article Federal Law No. 24 of 2006 Concerning Consumer Protection. However, photographs illustrating the Products are only indicative and are not contractual. MAD House shall not be held liable should they be incorrect in any way.

Products conform to the UAE legislation. Responsibility for MAD will not be liable in the event of non-compliance with the legislation of the country where the product will be delivered. The User has to check with local authorities in the country of delivery the possibility to import or use of products and services he intends to order.

MAD House cannot guarantee that the information listed on the packaging of the products is translated into all the languages of the European Union. However, this information is available at least in French and/or English.

For any question regarding the products, any questions or request for advice, the User may contact Customer Service from the “Contact” section of the Site.
Buyer may also visit a MAD boutique, physical point of sale for personalized advice and test the products offered for sale on the Site.

The prices of Products and services are firm and given in Dollars ($). They are fixed by the rates in effect on the day of the order. The current rate is that indicated on the Site unless there is a typographical error. All orders are billed at the price including tax, with the UAE VAT applicable on the date of the order. Any change to the VAT rate will be reflected in the price of the Products presented on the Site, on the date stipulated by the decree of application relating thereto.

MAD House reserves the right to freely change the prices of Products at any time and without notice, without other formality than making changes to the Site. However, these changes will not affect orders that MAD has accepted before the entry into force of these changes and the Products will be charged on the basis of the rates in effect when the order was placed, on condition of the availability of the Products ordered.

The prices shown do not include delivery costs, which will be charged extra and will be specified to the User during the final confirmation of the order when the total price will be shown on the order summary.
The price is that shown on the order confirmation sent by e-mail to the Purchaser by MAD.

Methods of ordering

The User can access the various Products offered for sale by MAD on the www.madperfumery.com Site. The User can freely browse the pages of the Site, without being committed to an order.

If the User wishes to place an order, he chooses the Products that are of interest to him and demonstrates such interest by clicking the “Add to basket” button.

Each new addition to his basket will be indicated by the appearance of the number of articles in the basket at the top right of the page.
At any time, the User may:

Obtain a summary of the Products he has selected or modifies his order by clicking on the “Card” accessible at the top right of each page;
Continue his selection of Products;
Complete selection of Products and order them by clicking on “SHOP”.

The User must then identify himself:

Either by entering his email address and password, if he is already a registered User.
Or by accurately completing the form made available, on which he will enter the information necessary to identify him and include his full name, email, and mailing address.
The User is informed and agrees that entering any identifier is considered valid proof of identity and expresses his consent.

Once identified, an order form will appear on the screen, summarizing the nature, quantity, and prices of Products selected by the User, and the total amount of the order, the User’s details, and the address for delivery of the Products.

The User shall then choose the delivery address. Depending on the destination, he can choose between a delivery option available on Mad Perfumery website.

The User must select the payment method offered on the same page. MAD uses a secure e-payment transactions tool that is provided by the ADCB BANK.
The amount of each order is limited to 5000 Dollars per order. The same reference product cannot be ordered for an amount greater than 10 items per order.

When the Purchaser submits his order and payment, a summary is displayed and includes the transaction number. This summary is sent to him in an order confirmation e-mail by MAD. This confirmation includes all the elements of the contract between the Parties.
Then, when the order is prepared and shipped, an e-mail shipping confirmation is also sent to the Purchaser.

Availability of products

Products are offered within the limits of available stocks. MAD does not guarantee the availability of the Products presented on the Site. The Purchaser shall be informed as early as possible of any Product availability. The Purchaser shall be notified of this information by e-mail prior to delivery and following the validation of the order.
MAD House will then arrange to subtract the sales price(s) of the unavailable Product(s) from the amount withdrawn from the Purchaser’s bank account.

All orders may include a maximum of three (3) samples selected by the client. These are available while stocks last. In case of unavailability of some samples, MAD House reserves the right to exchange it with another sample without informing. Liability cannot be accepted by MAD House for incorrect samples quantity due to technical problems with the website www.madperfumery.com.

In cases where the unavailability of a Product is noted after the order is validated, the Purchaser will have the opportunity to cancel the order by either requesting a refund of amounts paid within thirty (30) days at the latest after their deduction, or the exchange of unavailable Product(s), by e-mail sent to customercare@madperfumery.com.

MAD Perfumery & Cosmetics incurs no liability for out of stock or unavailable Products.

Retention of ownership

The Products ordered remain the property of MAD Perfumery & Cosmetics until full payment of their sales price. In the event of a payment incident, you agree to return the Products received to MAD Perfumery & Cosmetics upon the first request.

However, on the actual date of delivery, the risks (including loss, theft or damage) concerning the Products delivered are assumed by Purchaser.

Unless the server is unavailable, the orders are paid in Dollars ($) on the Site immediately upon registration of the order.

The user has to choose the payment method among those proposed and make payment.

MAD Perfumery & Cosmetics uses a secure e-payment transactions tool that is provided by the ADCB BANK.

MAD Perfumery & Cosmetics reserves the right to refuse any order or delivery in case of exceeding the limits outlined in the preamble hereof; dispute with the Purchaser; total or partial nonpayment of a previous order by the customer; the refusal of authorization of card payment by the banking organization; non-payment or partial payment.

The Purchaser guarantees the MAD Perfumery & Cosmetics that he has the required authorization that may be necessary to use the chosen method of payment at the time of checkout. In case of refusal by the bank, the order is automatically canceled and the customer is alerted by e-mail.

As part of the fight against fraud on the Internet, MAD Perfumery & Cosmetics uses a secure e-payment transactions tool that is provided by the ADCB BANK and guarantees the customer that it has never had access to confidential information relating to the method of payment used by the Purchaser to pay for his order.

This is why the consumer’s bank details will be required for each subsequent order they wish to place on the Site.

Delivery types

Dispatch time is a maximum of 48 working hours (from Sunday to Thursday). This time corresponds to the time taken to prepare your order at our depot (destocking, checking, preparation of the package, packing, labeling, etc.).

You can choose the transporter according to the delivery type /country that you have selected:

Emirates Post, standard shipping in UAE, delivered 48 to 72h
fetcher, express shipping in UAE, delivered 24 TO 48h
FEDX, standard shipping within Europe, delivered 48 to 72h
An additional delivery schedule must be considered for orders containing an engraved product. This delay may be up 10 business days.

Delivery prices

Delivery prices are automatically calculated when you place your order, according to the delivery type and country selected. You can view the price by going to your basket:

We currently ship to the following countries:
UAE, Saudi Arabia, Kuwait, Oman, Bahrain & rest of the world if there is no conflict with a rules and regulation.

RECEIPT OF THE PACKAGE

The package is delivered directly to your address. If you’re not at home when the delivery arrives, an attempted delivery notification will be delivered to your email. This notification will indicate the date and time of the attempted delivery, together with the post office where you can collect your package.

Upon delivery of the order, you must check the conformity and the status of your package in the presence of the carrier and notice all relevant concerns about apparent defects (missing product, damaged package).

You are invited to contact the Customer Service within 14 days of receipt. Except for legitimate reasons, any claim beyond this period will be considered inadmissible.

If after 7 days you still haven’t received your package, and no notification has been left, please try checking the status of your package on the Emirates Post, Fetchr or FEDX website, according to the delivery type selected. Return and refund

The sold items can’t return it but you can exchange it with other products and it has to be Parallel to the amount you ordered or greater and the Delivery prices will be paid by the client
No return or refund will be accepted for an engraved product.

In order to return the unwanted product, simply follow the 4 steps as indicated on the returns form attached to your package:

Contact our customer service customercare@goutalparis.com to obtain a return label via email.
Send back the item in its entirety and in its original packaging. Only items returned in their original state will be accepted and exchanged.
Attach a return form completed and a copy of your invoice to the package.
Return the package by FedEx to the address indicated below:

If the wrong product has been sent or the items are faulty, please contact customer services by e-mail at customercare@madperfumery.com or by phone at +971551111315.

The payment card that you used to pay for the order will be refunded, within 14 days of the date that the package is returned.

If the return is due to an error on our part, the customer has to contact customer service which will send a prepaid label on the condition of proof. If your product does not satisfy you, return costs are your responsibility.

Engraved items

Mad Perfumery & Cosmetics online store wwwmadperfumery.com offers a service of engraving on selected products. This service is applicable for deliveries to UAE and to the GCC countries listed in « Shipping and Return ».
Fees can be applied for the engraving. If so, the amount will clearly be indicated at every step of the customer’s order.
Engraving is undertaken by the company GD Laser and implies an additional delivery schedule up to 10 business days. Goutal is not responsible for any delay linked with the engraving realization.

The User can engrave the message of his/her choice with the limit of thirty (30) characters.
Mad Perfumery & Cosmetics can refuse an engraving if the message harms the rights of third parties, intellectual property law, good morals or any current law.
In this case, the User will be informed and offered the opportunity to cancel the concerned order.

The User takes on the exactness of the engraved message. No correction will be possible after the validation of the order. Mad Perfumery & Cosmetics will not be responsible for any typing error or spelling mistake.
The legal and contractual rights of withdrawal cannot be applied with engraved products. No return or refund will be accepted for an engraved product.

Gift boxes engraved & TV screen Gift boxes

Mad Perfumery & Cosmetics online store wwwmadperfumery.com offers a service of Gift Boxes with or without TV screen on selected products. This service is applicable for deliveries to UAE and to the GCC countries listed in « Shipping and Return ».
Fees can be applied for the Boxes. If so, the amount will clearly be indicated at every step of the customer’s order.
Mad Perfumery & Cosmetics implies an additional delivery schedule up to 10 business days. Mad Perfumery & Cosmetics is not responsible for any delay linked with the Mad Perfumery & Cosmetics realization.

Mad Perfumery & Cosmetics cannot be held liable for any use of the Products that are not in compliance with their intended purpose.

Mad Perfumery & Cosmetics does not warrant that the Site shall be available on a permanent basis, without temporary interruption, without suspension or without error.

Liability cannot be accepted by Mad Perfumery & Cosmetics for technical issues related to the website www.madperfumery.com.
Mad Perfumery & Cosmetics allows itself to cancel an order if the price or the quantity of some products falsified for any technical reason independent of its will.

Without limiting the scope of the other provisions of the General Terms and Conditions for Sale, Mad Perfumery & Cosmetics ’s liability can only be held against it in case of proven fault solely attributable to it. In any event, it will be solely limited to direct damages.

Mad Perfumery & Cosmetics reserves the right to suspend the operation of the Site.

Mad Perfumery & Cosmetics may collect personal data via its website from users requesting documents, subscribing to our newsletter or press releases, or creating an account or when ordering products on the website.
In accordance with in accordance with UAE Federal Law No. (1) of 2006 Concerning Transactions and Electronic Commerce, relating to data, files, and freedom, the processing of personal data collected on the Site and in boutiques has been registered on a secure database.

RIGHT TO ACCESS, CORRECT AND DELETE DATA AND TO OBJECT TO DATA PROCESSING

Major force

No Party shall be responsible for non-performance in whole or in part of its obligations under this contract if such non-performance is caused by an event constituting an event of force majeure.
Any events that meet the criteria established by the jurisprudence of the Civil Chamber of the Court of Appeal will be considered to be an event of force majeure.
The Party claiming an event constituting force majeure shall notify the other Party within five working days of the occurrence or threat of this event.
The Parties agree that they shall consult as soon as possible to jointly determine the methods for processing the order during the period of the event of force majeure.
Beyond a period of one (1) month of suspension due to force majeure, Mad Perfumery & Cosmetics may not honor the order and may be required to reimburse the Purchaser.

The entirety of the contract

These General Terms and Conditions for Sale and the order summary sent to the Purchaser form an entire contract, and constitute the entire contractual relationship entered into between the Parties.
In the event of a contradiction between these documents, the General Terms and Conditions for Sale shall prevail.

Intellectual property

Under these conditions, no one is authorized to reproduce, use, disseminate or use the intellectual property rights in any capacity whatsoever, even partially, without the prior written consent of Mad Perfumery & Cosmetics. Mad Perfumery & Cosmetics trademarks and logos are registered trademarks. Any reproduction is, therefore, an infringement.

The intellectual property rights attached to the Products sold on the Site are and shall remain the exclusive property of Mad Perfumery & Cosmetics and are subject to an exclusive license in favor of the Mad Perfumery & Cosmetics exclusively holds all rights of use.

Applicable law – litiges

These General Terms and Conditions for Sale and the contractual relationship between Mad Perfumery & Cosmetics and the Purchaser are subject to UAE law.
Any dispute arising from the application or interpretation of the General Terms and Conditions for Sale is under the exclusive jurisdiction of the courts of Abu Dhabi, the permanent location of Mad Perfumery & Cosmetics.
